Terms and Conditions for Submitting Notes

Radioplus Experts Ltd (“The Company) provides the opportunity for individuals to submit their notes ( “Notes” as more specifically defined below) to the Company for further showcase such Notes on our Site, various marketing campaigns, social media, and any digital assets or distribute such materials in any other way for the commercial or noncommercial purposes.

These Terms and Conditions for Notes Creation (these “Notes Terms”) are between the Company and the individual (referred to herein as “You” or “User”) desiring to submit such Notes to the Company via Our Site or e-mail.

By submitting the Notes You represent and warrant to us that You read these Notes Terms completely and understand them and that You are agreeing to be bound by these Notes Terms willingly.

Notes - means any brief written record of the contents of an article, book, or lecture, intended for subsequent recovery of information.

Site - means any application, platform, or website owned, managed, or created by Company, including but not limited to edubirdie.com (referred to herein as “Edubirdie”).

You must be at least 18 years or the age of majority in Your jurisdiction of residence (whichever is greater) to submit Notes to the Company. By submitting any Notes to Us, You represent and warrant to Us that You are at least 18 years or the age of majority in your jurisdiction of residence (whichever is greater) at the time of submission of your Notes to Us.

3.1 The Notes must be Your original work and must not infringe the rights of any other party. The Company accepts no responsibility if the User ignores these terms and conditions and the User agrees to indemnify the Company against any claim by any third party from any breach of these terms and conditions.

3.2 Your Notes must not include, and You hereby represent and warrant to Us that Your Notes do not include, material that:

i. violates or infringes any rights of any other party, including, but not limited to copyright, trademark, privacy, portrait rights, rights of publicity, moral rights, or any other intellectual property rights or civil rights;

ii. can be considered offensive, abusive, illegal, pornographic, threatening, or obscene;

iii. can be considered misleading, slanderous, libelous, illegal, or defamatory;

iv. promotes or commits an illegal act of any kind, includes the personal data of individuals or other third parties, solicits personal data of individuals or other third parties, or is fraudulent or deceptive; or

v. infringes or violates any applicable laws, rules, or regulations.

3.3 The Company l does not promise or guarantee that any Notes submitted to Us will be used by Us or any third parties acting under the Company's authority.

4.1. Any Note submitted by you shall meet the requirements:

- No detection of copyright infringement;

- No scans, photos, or screenshots of other works;

- No low uniqueness of the material;

- Shall not be inconsistent with the stated topic in the content;

- Shall be able to be displayed (please be aware of technical problems when uploading the text);

- There shall not be low readability of the text or inconsistency with supported formats.

5.1. You grant to the Company all intellectual property rights, including the right to use, reproduce, modify, publish, license and/or otherwise deal with (whether for commercial or noncommercial purposes) the accepted Notes.

By submitting the Notes, You also represent and warrant that You solely own or control all rights, title and interest in and to the Notes, including all copyright, trademark, rights of privacy, portrait rights, rights of publicity, moral rights and other intellectual property rights, or that You have obtained all necessary rights and licenses from all right holders to grant to us intellectual property rights. Upon written request from Us, You agree to provide any written legal releases or licenses for such material in Notes from the relevant third party, in a form satisfactory to Us.

5.2. You grant permission to the Company, and to those acting under the Company's authority, to use your name, picture, likeness, biographical information, and statements in advertising and promotional materials, without further compensation or permission, except where prohibited by law.

4.3 You hereby waive Your moral rights in Your Notes, to the extent moral rights can be waived in the applicable jurisdiction. To the extent not covered by the waiver of moral rights or if such waiver is not permitted by the law of the applicable jurisdiction, You agree to allow the Company and to those acting under the Company's authority, to determine, in each party’s reasonable discretion, whether Your Notes will be used anonymously or with indication of Your name or pseudonym. If You believe Your Notes has been misused, You agree to notify us and take no action without our prior written consent.
