Discipline Case Study Flowchart Carrie has a language impairment. She is a 15-year-old high school student. Her main struggles are expressing her feeling and thoughts. Below it a flowchart discussing her behavior towards a bus driver. For the manifestation determination, two things will be decided: 1) was the bad behavior caused by the child’s disability or 2) was the bad behavior a result of an IEP not being implemented (Manifestation determination in school discipline, 2022). Part 1: Flowchart YES If the behavior was a result of Carrie’s disability: 1. The suspension will not stand. Carrie will be able to return to school. 2. Carrie will be allowed back on the school bus and no special transportation will be needed. Two things must be implemented or reevaluated:  A functional behavior assessment  A behavior intervention plan revised to include behavior on the bus (if not in the plan). Carrie must be able to follow the rules set in the IEP to be allowed to ride the school bus for the remainder of the school year. Manifestation Determination for Carrie NO If the behavior was not a result of Carrie’s disability: 1. The suspension will stand. Carrie will stay out of school for 11 days. 2. Carrie will be provided special transportation and not allowed back on the general education school bus. After the manifestation determination, the IEP team will have to make the appropriate changes to Carrie’s plan. It should state: 1. Any transportation changes 2. Any behavioral intervention changes to help correct the bad actions. Carrie must return to school and ride on the special transportation set up by the school. Additional Steps Carrie must be able to sit in the seat assigned to her on the school bus. an FBA (functional behavio Carrie’s behavior will be reviewed at the end of school. If Carrie has been able to ride the bus without any altercation, she will be allowed to return to the general education school bus the following year. (behavioral intervention plan. The IEP team will meet to execute both of these. An FBA will help the team finds ways to implement interventions so Carrie’s behavior improves. The BIP will state the actions that everyone will take in order to help Carrie’s behavior improve. Carrie’s parents also are questioning why the school would change Carrie’s transportation listed in the IEP which states she is to ride on the “general education” school bus. Once Carrie’s manifestation determination is complete and the ruling is yes, everyone will be required to implement the changes which will allow her to remain on the transportation listed in her IEP. Part 2: Analysis All students with disabilities have a legal right to have a free appropriate public education, even including general education transportation (Latham, 2022). Carrie struggles with being able to share her thoughts and feeling appropriately. Throughout the school year, Carrie has not received any disciplinary action for bad behavior. After using poor choice of words, when speaking with the bus driver, Carrie has been suspended from school and expelled from the bus. Before a decision was made, the principal should have looked at Carrie’s record to check her previous behavior. With the manifestation determination taking place, the principal must allow Carrie to return to school. Carrie cannot be expelled and has the right to return to her current placement listed in her IEP if the behavior was caused by her disability (Manifestation determination meeting, 2020). Also, federal law requires that when placement changes due to bad behavior, the child with a disability must have an FBA (Manifestation determination meeting, 2020). Once the FBA has been implemented, the school must include goals for changing or avoiding the behavior in the IEP. If the manifestation determination states that the bad behavior was not due to a disability, the school has the legal right to discipline the student, as they would any other student. But, the manifestation determination could state that an IEP was not followed, causing the bad behavior. If this is found, regulations require that steps be taking the fix the deficiencies and the IEP be followed (Manifestation determination in school discipline, 2022).
