COLLECTIVE BARGAINING Collective bargaining involves goodfaith negotiations between employer and employees, represented by a trade union, to reach mutual understanding on work terms, conditions and aspects. Features include representation, selfconfidence through facts, self-reliance, compromise, private process without third parties, adherence to industrial charter for resolving disputes at lowest level, preparation with facts, and willingness to accept offers. Compulsory Adjudication When collective bargaining fails, disputes are resolved through compulsory third-party adjudication. Merits of Adjudication  Impartial third party  More experienced judges  Closer use of law  Fair hearing for both parties  Provides final binding verdict Demerits of Adjudication  Time-consuming investigation  Complicated procedures  Risk of disadvantage to employees due to employergovernment nexus Merits of Collective Bargaining  Democratic with representative negotiation  Resolves disputes at lowest level  Amicable dispute resolution satisfying both parties  Enhances industrial peace  Reduces expenditure resolution  Provides emotional release through airing issues and clarifications government on dispute Demerits of Collective Bargaining  Requires extensive fact-finding and research  Information asymmetry disadvantaging workers  Can lead to unrealistic demands by employees  Overlooks individual grievances Grievances A grievance refers to any employee discontent or complaint regarding perceived violation of expectations, agreements, responsibilities etc. by either party. It signals an underlying problem. Grievances arise due to issues in industrial relations, organizational norms, rule violations, and management's responsibility towards employees. In summary, collective bargaining, adjudication and grievance redressal are methods used to resolve industrial disputes and employee discontent. Each has its merits and demerits. Managers need skills to balance employee relations for organizational harmony.
