Board of Education, the system was established to harm minority students. The separation here in this example is not forced, certain students could choose to go to the separate school. In Brown v. Board of Education, the students were FORCED to go to different schools. The classes in the example are not to be designed to be equal, in Brown v. Board of Education, the classes were designed to be equal. Thus, this example is not similar to Brown v. Board of Education and would likely be allowed. If the majority of students were a minority race and the minority of students were Caucasian, this could be seen as favoring one race over another and thus not be allowed under Brown v. Board of Education. If however the minority in this district are minority students this might be allowed under Brown v. Board of Education and providing an equal opportunity to minority students.
