Course : International Law Lecture : Erwin Credit Hours : 3 Credits Semester Sessions : 3 Semester, 2021/2022 Session Prepared By : Pegyy Dania LECTURE NOTES Forms of International Law International law has several forms of manifestation or development patterns that specifically apply in a particular part of the world, including: 1. Regional international law: applies or is limited to the area where it applies. For example: American/Latin American international law, the concept of the continental shelf which first grew on the American continent and became general international law. 2. Specific international law: applies to certain countries. For example: the European convention on human rights. Sources of International Law Basically, the sources of international law are divided into two, namely formal and material legal sources. The formal sources of law in international law are confirmed in the Statute of the International Court of Justice, article 38 paragraph (1) where the sources of international law used by the court in adjudicating cases are as follows: International treaties: the main or primary legal source of international law, whether in the form of: - law making treaty (international agreement that establishes generally applicable international law provisions) for example: 1961 Vienna Convention on Diplomatic Relations - treaty contract (an international agreement that establishes the provisions of customary international law that apply to two or more parties and makes them apply specifically to those parties). International custom: custom proven in general practice and accepted as law. For example, welcoming guests from other countries. For example: UN, IMF, ASEAN, European Union International Red Cross The Holy See of the Vatican, recognized as a subject of international law since the Pact of Liberation was signed in 1929.
