Flow of Contract Arrangement How to Acquire a Block Petroleum Working Area to be offered for tender 1 Announcement Petroleum Working Area ready to be tendered 2 Bid Invitation Technical Guidance for Bidder (USS) 3 Bid Information Data Package (USS) Bid Submission Program including Commitment, Working 4 Access to MDM Center 5 Bid Participation 6 Bid Evaluation Company Capability and Commitment Warranty Bid Evaluation to allow the Government Tender Team to decide the Winning Bidder The Government Negotiation Team and the Winning Bidder negotiate on 7 Contract Awarded the contract's term and conditions. 1. Announcement The government of Indonesia announces a New Petroleum Working Area to be offered for tender. 2. Bid Invitation A special announcement specifying which New Petroleum Working Areas are ready to be tendered. 3. Bid Information Contains information on the tender process including instructions for the bidders. 4. Access to the MDM Center The MDM Center was established by the government of Indonesia to provide easy access to the data for all users, including investors. All investors must access the data at the MDM Center before participating in the tender process. 5. Bid Participation The tender bidders should submit their Working Program Commitment, Technical Evaluation, Information on Company Capability and Commitment Warranty to the Government Tender Team. 6. Bid Evaluation The Government Tender Team will decide the winning bidder based in the result of the evaluation on the bidder proposal. The Government Tender Team will report the result to the Minister of Energy and Mineral Resources. 7. Contract Award The Government Tender Team will give the draft PSC Agreement to Pertamina, which will set up the initial contract terms and conditions with the contractor. Then, the Minister will report to the President for approval. Consortium Arrangement Bid Information For a group/consortium, the lead company is registered for 1 (one) set of bid information docu-ments, and is allowed to copy the document for its fellow members. Data Review For a consortium, the lead company is registered as 1 (one) entity, and is allowed to bring a partner to review the data. Data Access A consortium is entitled to one data package for each consortium member. The data packages will be priced according to the formula [n x 100%] - [(n-1) × 60%]. For example: • If the consortium consists of 2 (two) members, the price will be 140% of the single data package price for 2 (two) sets of data packages. • If the consortium consists of 3 (three) members, the price will be 180% of the single data package price for 3 (three) sets of data packages. • If the consortium consists of 4 (four) members, the price will be 220% of the single data package price for 4 (four) sets of data packages. • Etc. A company that has already obtained all or some of the data included in the data package, or that has the right to use that data, can apply for a discounted data package price by showing its "license to use data" or "secretion agreement".
