About Environmental Law

ENVIRONMENTAL LAW Law is present not only because of problems between issues or when there is interaction between humans and other humans, law must also be present because there are problems that might arise from interactions between humans and the environment. This is complex, not only in the public area but also in the private area so that a new scientific discipline emerges, namely environmental law. The interaction of humans and the environment needs to be accommodated in a scientific discipline so that environmental law develops as a branch of science whose main principles are rooted or based on legal and ecological principles. The term environmental law in England uses the term environmental law, in the Netherlands it is called milleurecht while in Indonesia it is some call it environmental law and environmental governance law. The role of environmental law, among others: 1. Gives a deterrent effect, meaning that environmental law exists to ensure that the concept of sustainable development is actually carried out through policies formulated by stakeholders. 2. As a means of compliance, through the application of this environmental law, it is hoped that this human being will become obedient with the sanctions given. 3. To provide guidance to the public regarding actions that can be taken to protect their rights and obligations, environmental law is made to be a tool or guideline that can be used by the community when their rights related to the environment are violated. For example, there are residents who depend on the river flow around their house, but it turns out to be polluted, so the rights of the surrounding community have been taken away, so they need to protect themselves and their rights. Environmental law exists to provide definitions or limitations regarding rights and obligations and behavior that harms the community. , giving and strengthening the mandate and authority to related government officials to carry out their duties and its function as the legal basis of the government, and regarding how to make policies related to the protection and management of the environment. According to Munadjat Danusaputro, he said that environmental law in a simple sense is as a law that regulates the environmental order where according to him there are two kinds of environmental law, namely modern environmental law which is oriented towards the current environment and the second is classical environmental law which is oriented about how we can optimize the environment to meet human needs. Takdir Rahmadi divides environmental law into four areas, namely: 1. Environmental planning law. The law on environmental planning includes the subject matter of analysis of environmental impacts and the designation and utilization of space in an area. 2. Environmental pollution control law. This environmental pollution control law includes laws on the prevention and control of environmental pollution such as waste disposal permits. 3. Environmental dispute resolution law. Environmental dispute resolution law consists of legal provisions for dispute resolution through the judicial process or through a process or procedure for resolving disputes outside the court. 4. Natural resource law Natural resource law is related to natural resource extraction permits, criteria for raw materials that cause environmental damage, protection of natural resources and so on.
