Key terms and Treaties for the European Union Law course ACT CLAIR DOCTRINE- under this, decisions of the ECJ are binding precedent on all MS national courts, not just the particular national court that referred to the issue of interpretation. BREXIT- this term was coined to mean the end process of the UK leaving the EU; the UK left the EU on 31st January 2020. CHARGED HAVING EQUIVALENT EFFECT (CEES)- charges which are equivalent in practical effect to CD’s. COMPETITION AND MARKETS AUTHORITY (CMA)- the body responsible for enforcing compliance with EU competition law within the UK (formerly the Competition Commission). COURT OF AUDITORS- the body responsible for auditing income and expenditure within the EU, and for ensuring compliance with the EU budget. CUSTOMS DUTIES (CD’S)- customs duties imposed by states on goods in transit across national borders. DIRECT DISCRIMINATION- this is a discrimination in law (for example in the context of free movement of persons, foreign workers explicitly being treated less favourably than domestic workers.) DIRECT EFFECT (DE)- some provisions of EU law may be directly effective, meaning that they confer rights on individuals which can be enforced in national courts. ENUMERATION/CONFERRAL- a principle which requires all actions of the EU to have a legal basis arising from a treaty, whether express or implied. EUROPEAN CENTRAL BANK (SCB)- the EU’s central bank, responsible for administering monetary policy within the Eurozone. EUROPEAN CHARTER OF FUNDAMENTAL RIGHTS (ECFR)- EU legislation designed to protect human rights which individual EU MS’s are signatory to (but not the EU itself) and which is binding on some (but not all) MS’s under the Treaty of Lisbon. EUROPEAN COMISSION (EC)- the executive body of the EU responsible for managing its day to day business- do not confuse with the Competition Commission (old name for the Competition and Markets Authority). EUROPEAN CONVENTION ON HUMAN RIGHTS (ECHR)- an international convention designed to protect human rights, drafted by the Council of Europe. The ECHR is incorporated into UK domestic legislation by the HRA 1998. EUROPEAN COURT OF HUMAN RIGHTS (ECtHR)- the highest court in the EU and the final arbiter in interpreting EU law. Part of the Court of Justice of the European Union (CJEU). EUROPEAN PARLIAMANT (EP)- the legislative body of the EU. European Union (EU)- a politico-economic union of 27 member states which have come together to pursue common goals in a range of policy areas. The UK is no longer a member. EUROZONE- the area covered by the 19 EU member states which have adopted the EU as their currency.
