Eu law notes for llb law course The commission is supported by about 32,000 civil servants. Article 17(1) TEU gives an overview of the Commissions powers and functions. It is required to promote the general interests of the EU, ensure the application of the Treaties, oversee the application of the EU law (under the control of the ECJ), execute the budget and exercise coordination, executive and management functions.    The Commission is not responsible for the EU’s common foreign, security and defence policy- this is the responsibility of the High Representative of the Union for Foreign Affairs and Security Policy. The commission is a form of a ‘cabinet government’. It consists of one member from each MS and serves for a term of five years (Article 17(3)). Each member must be politically independent. The commission is headed by the president who is nominated by a qualified majority of the European Council and then elected by a majority of the European Parliament, the President then selects the other 36 members of the commission from the other member states, who recommend candidates. The list of candidates must be agreed with the Council of the European Union and then all 27 members must be approved collectively by the European Parliament. Article 17(6) TEU defines the powers of the president. The president shall: a. Lay down guidelines for the European Commission; b. Decide on the Commission’s internal organisation; and c. Appoint Vice Presidents (apart from the High Representative for Foreign Affairs and Security Policy (the ‘High Representative’) Each commissioner is assigned a ‘policy portfolio’ by the President (e.g. transport or the environment). The President may also require any member of the Commission, including the High Representative, to reign. The President has most control.
