The broad/non-juridical approach-New Criminology -Broaden the search to look for reasons why the behaviour took place -New-Criminology insists that crime and deviant behaviour are the same - Hold the view that you cannot focus on crime alone but also study any behaviour that is acceptable to the majority of people -Society usually determines what constitutes as 'wrong', 'wrong doing' and deviant behaviour - the non juridical definition of crime includes behaviour that violates social norms and potentially endangers Society (not against the law or legally punishable) - Believes that the crimilisation and decrimilisation of behaviour is determined by power structures within a community -:: new criminologists suggest that there will be less crime in a fair, equal and just society -Focuses on social injustices: power of the elite brings about social injustices and economic violence By the state eg: inadequate housing + healthcare + limited job opportunities Joften results to protest due to poor service delivery -sees basic human rights as a prerequisite for human well-being * In addition young people below the age of 18 may come into conflict with the law for behaviour eg: underage drinking *The age of the person determines their status in the system and certain actions by under aged children (below 18) are deemed criminal: these actions are known as status offences *: when minors perpetrate such actions the cas deems it to be illegal as a result of their under-age status * But when committed by adults (consumption of alcohol) these actions are not seen as Criminal it is Socially accepted adult behaviour
