ETHICAL AND LEGAL ASPECTS OF NURSING Objectives At the end of this lecture, , the students will be able to: 1. List sources of law and types of laws. 2. Differentiate between negligence and professional negligence/malpractice. 3. Recognize regulation of nursing practice with selected aspects of credentialing and standard of care 4. Describe the essential elements of informed consent and delegation 5. Discuss legal protections in nursing practice in term of documentation and incident report 6. Discuss the legal responsibilities of nursing students. 7. Differentiae between types of personal and processional values 8. Differentiate between bioethics and nursing ethics 9. Explain how moral principles and codes of ethics affect moral decisions. 10. Discuss the advocacy role of the nurse LIABILITY Is the quality or state of being legally responsible for one's obligations and actions and for making financial restitution for wrongful acts. .e.g. A nurse has an obligation to practice and direct others under her supervision so that harm or injury to the client is prevented and standards of care are maintained Torts Unintentional Malpractice Is a professional negligence that occurred while the person was performing as a professional. It applies to primary care providers, dentists, lawyers, and generally includes nurses. Negligence Is misconduct or practice that is below the standard expected of an ordinary, reasonable, and practical person. Such conduct places another person at risk for harm. Both nonmedical and professional individuals can be liable for negligent acts.
