Despite the efforts of judges and legislators, the criminal law of Wales continues to be a source of discrimination. Discuss with reference to two areas of discrimination (you may choose from any area of discrimination, for example, discrimination based on race, gender, sexual orientation, age, disability, or religion).
A body of laws that apply to criminal acts is referred to as criminal law. So criminal justice is put in place to uphold justice by bringing peace to our rather chaotic society, to ensure a level of fairness by finding justice for victims affected by crime, and lowering the likelihood of reoffending criminals. This is accomplished by assisting them in becoming more educated and learning life skills. Regardless of race, gender, or age, all people are equal before the law and should be treated equally. Criminal law justice in Wales has evolved and is a unique blend of traditional and modern institutions, agencies, and procedures. The criminal justice system is made up of the police service, the crown prosecution service, the courts, and the probation service. However past cases and evidence have shown that criminal law in Wales is still discriminating against people mostly black people and other races and those who have a different sexual orientation.
Firstly, many situations have shown that black people are treated unfairly by police in Wales. By the end of 2016, there were 386,474 stops and searches were 58,397 were people identified as black or Black citizens. this shows that black people are 6.5 times more likely to be stopped and searched than other races. For example, in 2017, Nuno Cardoso was one of five black men to die following the use of force by police, the majority of which relate to the policies' response to drug swallowing or consumption of it. During the arrest, restraint, and batons were utilized. Nuno was found to be intoxicated, according to the inquiry. Officers can be heard discussing the potential that Nuno had anything in his mouth in the body-worn footage of the arrest, which was revealed to the inquest. Nuno was not speaking adequately with the authorities at this time. One of the Ruskin College witnesses characterized Nuno as speaking with a full mouth. The cops threatened to send him to the hospital if he did not reveal to them what was in his mouth. Officers said at the inquest that they did not believe he had anything in his mouth. He may be in life if he would be sent in time in hospital by police and the jury decision was that Nuno died from cardiorespiratory arrest caused by the drug. Therefore, this case shows that officers are not being prosecuted for these deaths means they will continue to kill and abuse their powers as there are no consequences for their actions.
Nevertheless, the work of legislators to stop discrimination in Wales seems that has not stopped discernment in criminal law for citizens with different sexual orientations as known as LGBT. Legal paradoxes and rapid fluctuations in legal reforms highlight a variety of socio-legal issues, such as the fact that the law still does not completely include LGBT persons and that even when formal legal equality has been achieved, social inclusion and economic fairness remain exclusive. Legal experts and organizations seeking to protect the lives and intimate relationships of LGBT persons must examine claims of governmental recognition as the 'goalposts' of inclusion alter. Over the last 25 years, has made significant progress toward equality for persons of different sexual orientations. Although steps have been done to change legislation in schools, workplaces, and public agencies to combat anti-LGBT discrimination and bullying. Equal marriage has become a reality for many people, and Section 28 has been relegated to the past. However, the legal standards for LGBT people have not been converted into actual equality since they experience hate crimes and prejudice daily. Some measures were taken in 2013 to highlight the scope and gravity of the situation, however, the incidence of hate crimes against LGBT persons has grown dramatically since then, up to 2017. According to YouGov, over 5000 persons of various sexual orientations experience terrible levels of abuse, harassment, and discrimination daily. One in every five LGBT persons does not report to the police because they are afraid, they will not be taken seriously. Furthermore, four out of every five anti-LGBT hate crimes and incidents go unreported, with younger LGBT individuals especially hesitant to go to the police because this type of hate crime is not considered as serious as hate crimes motivated by other types of prejudice under the law. Anti-legal hate crime gets a lesser maximum punishment in Wales. Many organizations are demanding for the criminal justice system provide enough support to victims of LGBT hate crimes and to provide mandatory training to police officers on how to handle these situations.
In conclusion, the essay shows that even today days for criminal law in some ways still exist discrimination for those of a different race such as black people or people with sexual preferences. Even though there were takes some measures from the government with different plans to stop discrimination in the criminal justice system.
